LONG POND, Pa. --?Tony Stewarts insurance company does not have to cover the three-time Sprint Cup champion for any damages sought by the family of Kevin Ward Jr., a U.S. District Court judge ruled Friday.Stewarts car struck and killed the 20-year-old Ward after Ward exited his vehicle and approached Stewarts car on foot in a sprint-car race Aug. 9, 2014, at Canandaigua (New York) Motorsports Park.Tony Stewart Racing, which operates Stewarts sprint-car fleet, had policies with Axis Insurance Company, but Axis had argued in court documents that it did not have to cover Stewart because the Empire Super Sprints race was not included in the TSR policies.Those policies had $4 million in coverage, and a provision listed the events covered -- 65 World of Outlaws events, 30 USAC sprint-car events and 10 USAC Silver Crown events.Stewart had argued that the specific series listing was the result of underwriting confusion, and the policy covered TSR drivers competing in other events.[The] Policy is unambiguously limited by the Schedule of Events endorsement, which does not include the ESS Event where Stewart struck Ward. Therefore, Axis is not obligated to provide a defense or indemnification to Stewart in connection with the Ward Action, U.S. District Court Judge David Hurd wrote in a decision issued Friday.Stewart attorney Brian Gwitt said he had no comment on the decision and whether there would be an appeal.The decision leaves Stewart to pay all of his attorney fees in defense of claims from the Ward family, as well as any claims determined through a settlement or a trial.Wards parents seek unspecified damages, alleging Stewart could have avoided their son in the accident.The case is pending in U.S. District Court in Utica (Hurd is also the judge in that case) with a discovery deadline of Jan. 6. The deadline to file motions after discovery is Feb. 8 with no firm trial date set.Stewart, who was not indicted by a grand jury in Wards death, has said in court documents he didnt see Ward until just before Ward attempted to make contact with his car.He has said it was 100 percent accidental, and Stewarts court filings show Wards toxicology report indicates that he used marijuana within five hours of the race.
